Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ChatFortAI website and chat application operated at https://chatfortai.ai, https://chat.chatfortai.ai, and https://chatfortai-chat.duckdns.org (collectively, the "Service"), provided by Matthew Lopez ("ChatFortAI", "we", "us").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service (or the minimum age at which a person can consent to the processing of personal data in your jurisdiction, whichever is greater). By using the Service you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at contact@chatfortai.ai if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3. Acceptable Use

You agree not to use the Service to:

• Violate any law, regulation, or third-party right;
• Generate, solicit, or distribute content that is illegal, defamatory, harassing, threatening, or that infringes intellectual property rights;
• Produce content depicting child sexual abuse material (CSAM) or any content that sexually exploits minors;
• Generate malware, phishing content, or tools intended to compromise computer systems;
• Attempt unauthorized access to the Service, its underlying systems, or other users' accounts;
• Reverse engineer, decompile, or attempt to extract model weights or proprietary components;
• Circumvent rate limits, usage quotas, or abuse-prevention mechanisms;
• Use the Service to build a competing product by systematically copying outputs;
• Submit the personal data of others without lawful basis to do so.

We reserve the right to investigate and take appropriate action — including content removal, account suspension, or termination — for conduct that we reasonably determine violates these Terms.

4. Your Content

4.1 What Counts as Your Content

"Your Content" means any text, files, prompts, responses, or other material you submit to or import into the Service, including files you import from Google Drive.

4.2 Ownership

You retain all rights you already have in Your Content. These Terms do not transfer ownership of Your Content to us.

4.3 License You Grant Us

You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process Your Content solely as necessary to operate and improve the Service and to fulfill your requests (including routing prompts to the AI model provider you select).

4.4 Responsibility for Your Content

You are solely responsible for Your Content and its lawfulness. You represent that you have the rights necessary to submit it to the Service.

5. AI-Generated Output

5.1 Nature of Output

The Service uses third-party AI models to generate responses ("Output"). Output is generated probabilistically and may be inaccurate, incomplete, outdated, biased, or offensive. Do not rely on Output for legal, medical, financial, or other professional advice. Verify important information independently.

5.2 Ownership of Output

As between you and ChatFortAI, you own the Output generated in response to your prompts, subject to any rights of the underlying AI model provider and to these Terms. Similar or identical Output may be generated for other users.

5.3 Your Responsibility for Output

You are responsible for your use of Output, including any decisions you make based on it and any content you share or publish that incorporates Output.

6. Third-Party Services

The Service integrates with third-party services including AI model providers and Google Drive. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services, and their availability or behavior may change at any time.

7. Google Drive Integration

If you enable the Google Drive integration:

• You authorize the Service to access files you explicitly select via the Google Picker (scope: drive.file);
• The selected file contents are processed as described in the Privacy Policy;
• You may revoke access at any time via https://myaccount.google.com/permissions;
• Use of the integration must comply with Google's Terms of Service.

8. Fees

The Service may be offered free of charge or on a paid basis. If paid tiers are introduced, pricing and billing terms will be disclosed at the point of purchase. We reserve the right to change pricing with reasonable notice.

9. Intellectual Property

The Service, including its software, user interface, text, graphics, and branding (excluding Your Content and Output), is owned by ChatFortAI or its licensors and is protected by intellectual property laws. Except as expressly permitted in these Terms, you may not copy, modify, distribute, or create derivative works of the Service.

10. Feedback

If you submit suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate them into the Service without obligation to you.

11. Suspension and Termination

• You may stop using the Service at any time and may request account deletion by emailing contact@chatfortai.ai.
• We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law.
• Sections that by their nature should survive termination (including Sections 4, 5, 9, 12, 13, 14, and 15) will survive.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATFORTAI AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless ChatFortAI and its operators from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Denver, Colorado, and you consent to personal jurisdiction there.

16. Changes to These Terms

We may modify these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after changes take effect constitutes acceptance. If you do not agree to a change, your sole remedy is to stop using the Service and request account deletion.

17. Miscellaneous

• Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and ChatFortAI.
• Severability: if any provision is found unenforceable, the remaining provisions will remain in full force.
• No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: you may not assign these Terms without our written consent; we may assign them freely in connection with a merger, acquisition, or asset transfer.
